These Terms & Conditions (“Terms”) govern your access to and use of the website and services of Flames & Fabrics (“we,” “us,” “our”) and your purchase of any products (candles, fabrics, etc.). By using our website or placing an order, you agree to be bound by these Terms.

  • We endeavor to display product colors, details, and images as accurately as possible, but we cannot guarantee that your monitor’s display will reflect true colors.

  • We reserve the right to change prices, correct errors, or adjust costs without prior notice.

Shipping & Delivery:


  • Shipping times are estimates and not guaranteed. Delays may occur due to carrier delays, customs, etc.
     
  • Buyers are responsible for any customs duties, import taxes, or other fees imposed by their country.
     
  • Title and risk of loss for purchased products pass to you when we deliver the products to the shipping carrier, unless we agree otherwise.
     

Warranties & Disclaimers:


  • We warrant that products will be free from defects in materials and workmanship at the time of delivery.
     
  • Except for the above, all products are provided “as is” and “as available,” without further warranties—express or implied—including implied warranties of merchantability or fitness for a particular purpose.
     
  • Under the Magnuson–Moss Warranty Act, if we provide any written warranty, we must disclose its terms clearly. 

 

  • Our liability is limited to replacing defective items or refunding the purchase price, as further detailed in the Return & Refund Policy.
     

Limitation of Liability:


To the fullest extent permitted by law, Flames & Fabrics shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, loss of data, etc.), even if advised of the possibility of such harm. Our aggregate liability is limited to the amount you paid for the product at issue.


Indemnification:


You agree to indemnify, defend, and hold harmless Flames & Fabrics, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising out of (i) your use of the website or purchase, or (ii) your violation of these Terms.


Intellectual Property:


All content on the website (text, images, logos, designs) is our property or licensed to us. You agree not to reproduce, distribute, modify, or create derivative works without our prior written consent.


Termination:


We may suspend or terminate your access or use of the site (or your account) at any time for any violation of these Terms or for other business reasons. Sections that by their nature survive termination (e.g. limitation of liability, indemnification) will survive.


Governing Law & Dispute Resolution:


  • These Terms are governed by the laws of the State of Florida (USA), without regard to its conflict of laws principles.
     
  • Any dispute arising from or relating to these Terms or your purchase shall be resolved in the courts located in Lake County, Florida, and you consent to personal jurisdiction in those courts.
     
  • If any provision is found invalid or unenforceable, the remaining provisions will continue in full force.
     

Changes to Terms:


We may modify these Terms from time to time. We will post the updated version and update the “Last Updated” date. Your continued use or order placement after changes constitute acceptance of the updated Terms.


Severability & Waiver:


If a court finds a provision invalid, it will be limited or eliminated as necessary, but the remaining provisions will continue in full force. Our failure to enforce any right under these Terms is not a waiver of that or any other right.


Return and Refund Policy

 

This Return & Refund Policy sets out your rights to return and receive refunds or replacements for products purchased from Flames & Fabrics, and our obligations under U.S. and Florida consumer law.


Your Rights & Our Approach:


  • We allow returns, refunds, or exchanges subject to the terms below.
     
  • Under Florida law, if a merchant does not offer refunds or exchanges, it must conspicuously post a “no refund / no exchange” notice at the point of sale. Privacy Policies+2Florida Legislature+2
     
  • If no conspicuous policy is posted, buyers may have the right to a refund within 7 days for new, unused goods. Privacy Policies+1
     
  • This Policy describes how we handle returns for defective or non-conforming goods, and voluntary returns when permitted.
     

All Sales are final unless product defect:


To be eligible for a return:
a) The item must be unused, in the same condition as received, with original packaging and tags.
b) The return request must be made within 30 days of delivery (unless otherwise stated).
c) You must provide proof of purchase (order number, receipt, etc.).

Note: Some items may be non-returnable (custom, bespoke fabrics, made-to-order items, clearance sales) — these will be clearly marked as “final sale” at the time of purchase.


Return Process:


  1. Contact us at [customer-service email] within 30 days of receipt to request a return, stating the reason and order details.
     
  2. We will evaluate your request and, if approved, provide you with a return authorization (RMA) and the address to return the item.
     
  3. You must ship the product back to us in its original condition, appropriately packed, within [7 business days] after authorization.
     
  4. You are responsible for return shipping costs, unless the return is due to our error (defect, wrong item) — in that case, we will reimburse or arrange the return shipping.
     
  5. Use a trackable shipping service; you bear the risk of loss until we receive it.
     

Refunds, Exchanges & Timing:


  • Refunds (or credits) will be issued to the original payment method (credit card, PayPal, etc.), unless you request store credit and we agree.
     
  • Refunds will be initiated within 7–14 business days after we receive and inspect the returned item. Return Prime
     
  • Shipping and handling charges are not refundable (unless the return is our fault).
     
  • If the item is found to be not in original condition, used, damaged, or missing parts, we may refuse a refund or issue a partial refund.
     
  • Exchanges: If you request an exchange (same item, different size/color) and we have stock, we will ship the replacement after receiving the returned item, and you may have to cover additional shipping costs.
     

Defective or Incorrect Items:


  • If you receive a defective or incorrect item, you must notify us within 7 days of delivery.
     
  • We will arrange replacement, repair, or refund at no extra cost.
     
  • In some cases, we may ask you to return the defective item; we will cover or reimburse the return shipping.
     

Restocking Fees & Deductions:


We generally do not charge restocking fees. However, if an item is returned in a condition that requires cleaning, refurbishing, or missing parts, we may deduct a reasonable amount from the refund. Any such deductions will be explained in writing.


Non-Returnable Items:


Certain products cannot be returned or refunded, including (but not limited to):

  • Custom, made-to-order, or personalized items
     
  • Clearance / deeply discounted / final sale items
     
  • Items that have been used, washed, or damaged
     
  • Gift cards, downloadable digital products (if applicable)
     
  • Any products marked as “non-returnable” at purchase
     

Cancellation Before Shipment:


If you change your mind and cancel an order before it ships, you may request cancellation. Refund of the purchase price (minus any payment processing fees) will be made within 7 business days.


Consumer Rights / Legal Disclosures:


  • Nothing in this Policy is meant to limit rights that consumers have under applicable U.S. federal or Florida laws.
